1. Introduction

Welcome to Rey Tracker (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the Rey Tracker website, mobile applications, IoT devices, and services (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

 

2. Definitions

In these Terms:

  • “User” refers to any individual who accesses or uses our Services, including parents, guardians, school administrators, and bus operators.
  • “Child” refers to any minor whose location is tracked using our Services.
  • “IoT Device” refers to the GPS/GPRS tracking device provided by Rey Tracker.
  • “Content” refers to any information, data, text, graphics, images, videos, or other materials that may be viewed or accessed through our Services.

3. Account Registration and Security

To use certain features of our Services, you may need to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your account information.
  • Keep your account credentials secure and confidential.
  • Notify us immediately of any unauthorized use of your account or any other breach of security.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to disable any user account if we believe you have violated these Terms.

 

4. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use our Services in any way that violates any applicable federal, state, local, or international law or regulation.
  • Use our Services to track any individual without their knowledge and consent, or in the case of a minor, without the consent of their parent or legal guardian.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of our Services, the server on which our Services are stored, or any server, computer, or database connected to our Services.
  • Use any robot, spider, or other automatic device, process, or means to access our Services for any purpose, including monitoring or copying any of the material on our Services.
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

5. IoT Device Terms

If you purchase or use a Rey Tracker IoT Device, you agree to the following:

  • The IoT Device remains the property of Rey Tracker until full payment has been received.
  • You will use the IoT Device only for its intended purpose of tracking children for safety purposes.
  • You will not attempt to reverse engineer, disassemble, or modify the IoT Device.
  • You will not use the IoT Device to track any individual without their knowledge and consent, or in the case of a minor, without the consent of their parent or legal guardian.
  • You understand that the IoT Device requires regular charging and maintenance to function properly.
  • You acknowledge that the IoT Device’s functionality depends on various factors, including but not limited to GPS signal availability, cellular network coverage, and battery life.

6. Subscription and Payment

Certain features of our Services may require a subscription. By subscribing to our Services, you agree to the following:

  • You will be charged the subscription fee at the beginning of each billing cycle.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can cancel your subscription at any time through your account settings or by contacting our customer support.
  • We reserve the right to change our subscription fees upon notice to you. If you do not agree to the fee change, you may cancel your subscription.
  • No refunds will be provided for partial subscription periods or for periods where the Service was not used.

7. Intellectual Property Rights

Our Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Rey Tracker, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use our Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
  • If we provide social media features with certain content, you may take such actions as are enabled by such features.

8. Privacy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you and the children you register with our Services. By using our Services, you consent to the collection, use, and disclosure of information as described in our Privacy Policy.

 

9. Limitation of Liability

IN NO EVENT WILL REY TRACKER, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SERVICES, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON OUR SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

 

10. Indemnification

You agree to defend, indemnify, and hold harmless Rey Tracker, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.

 

11. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the City of San Francisco and County of San Francisco. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

 

12. Waiver and Severability

No waiver by Rey Tracker of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Rey Tracker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

 

13. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter.

Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
